Australian Mushroom Killer Loses Appeal, Faces Harsher Sentence

In Victoria, Australia, the Court of Appeal rejected Erin Patterson’s bid to overturn her murder convictions, adding that she will never be released from prison. Patterson, 51, had been found guilty of murdering three relatives and attempting to kill a fourth by serving them beef Wellington laced with death‑cap mushrooms in 2023. The original life sentence carried a 33‑year non‑parole period, a concession the appellate judges said was inappropriate given the severity of the crimes.

The three‑judge panel described the case as “extraordinarily cold and calculated” and stated that the criminality involved was “shocking” and “inappropriate to fix a non‑parole period.” Justice Stephen McLeish, speaking for the panel, said the case warranted a harsher approach.

Patterson’s trial had drawn national attention when a jury found her guilty of murdering her in‑laws, Don and Gail Patterson, and Gail’s sister Heather Wilkinson, after the trio ate portions of beef Wellington that contained lethal mushrooms. The jury also convicted her of attempting to murder Heather’s husband, Pastor Ian Wilkinson, who survived the poisoning but remains in hospital with lasting health issues.

Her appeal, filed in August, raised seven grounds, including alleged procedural errors, prejudicial evidence, and claims that the prosecution’s cross‑examination was unfair. The appellate court dismissed all seven arguments, leaving Patterson with 28 days to decide whether to pursue a further appeal to the High Court of Australia.

With the appeal denied, Patterson’s sentence is now set to be more severe, and the court has ruled she will never be released from prison. The case remains a stark reminder of the grave dangers posed by toxic mushrooms and the legal system’s role in delivering justice for such heinous crimes.
